McCune Law Group Launches Class Action Against Ford Over Seatbelt Issues
A class action lawsuit has been filed against Ford Motor Company by the McCune Law Group, a national firm specializing in consumer litigation and product liability. This legal action, submitted to the United States District Court for the Eastern District of Michigan, addresses alleged safety concerns regarding the inflatable seatbelt systems in 2011-2019 Ford Explorer vehicles.
The lawsuit, led by attorney Todd A. Walburg of McCune Law Group, represents the interests of current and former owners of affected Ford Explorers, including plaintiff Jeffrey Terrell. It claims that Ford failed to adequately disclose significant issues related to the second-row inflatable seatbelts. Introduced in 2011, these seatbelts are designed to enhance passenger safety but are now under scrutiny for their performance.
According to the complaint, the seatbelt system may unintentionally release or become stuck, which can trigger an airbag warning light on the dashboard. This malfunction raises serious safety concerns as it could lead to increased risks of accidents, injuries, or fatalities during a collision. The lawsuit asserts that the failure of the seatbelt system compromises the safety of all occupants.
The complaint also alleges that Ford has been aware of these issues through various channels, including numerous consumer complaints, feedback from dealers, and information from the National Highway Traffic Safety Administration. Despite this awareness, Ford reportedly did not take adequate measures to address the seatbelt malfunctions and instead suggested costly repairs that owners would have to cover themselves, even if the vehicles were still under warranty.
The lawsuit states that had the plaintiffs known about these defects prior to their purchase, they would have either opted not to buy the vehicles or paid significantly less for them. The legal action seeks compensation for all affected Ford Explorer owners, emphasizing the need for accountability in the automotive industry.
