Pentagon Unveils Free Access to 400 Patents for Industry Innovation

The Pentagon announced a groundbreaking initiative to enhance collaboration with the private sector by offering free access to approximately 400 patents from its laboratories. Under the leadership of **Emil Michael**, the Department’s Chief Technology Officer (CTO), this move aims to unlock the potential of military innovations that have not yet reached the market or battlefield.

During a conference in **Washington, D.C.**, Michael emphasized the need for greater accessibility to the vast intellectual property generated by the Pentagon’s **$3.3 billion** investment in its **216 laboratories**. He pointed out that many valuable technologies, while developed by talented researchers, often remain unknown to industry stakeholders.

“This is a frustrating point: Why do these innovations—thousands of them—created by the great minds in our labs not reach the warfighter?” Michael stated. To address this, he outlined a two-part strategy. The first step involves providing a **two-year Commercial Evaluation License (CEL)** for select patents at no cost, allowing companies to experiment with and develop these technologies.

The initial batch of 400 patents includes innovations such as a **Navy-developed drone tracking system** and advanced Army mortar fuses. These selections were made with the Pentagon’s top six **Critical Technology Areas** in mind. Michael’s team utilized artificial intelligence (AI) to streamline the selection process, ensuring that the chosen patents are both significant and commercially viable.

“Here are the patents we think are important, interesting, and have merit for product development,” Michael elaborated. He described this initiative as a “patent holiday,” aimed at encouraging businesses to explore these innovations without initial financial barriers.

If the pilot program proves successful and companies seek to continue using the patents beyond the trial period, Michael expressed a willingness to negotiate long-term arrangements. “See what you could do with them, see if you can make a business out of them, and then come back to us,” he urged industry leaders at the conference hosted by consulting firm SMI.

The Pentagon has previously licensed some patents but has not seen substantial revenue from this avenue. Michael noted that the current licensing fees generated are “infinitesimal,” attributing this to a lack of awareness among companies about the available patents.

Creating a Centralized Patent Database

The second part of Michael’s plan focuses on developing a comprehensive, searchable database that will consolidate patents from all 216 labs. The Pentagon plans to utilize a public-private partnership known as **TechLink** alongside an interagency database called **iEdison** to facilitate this effort.

Currently, **iEdison** contains patent information from around **36 federal agencies**, including ten from the Defense Department. However, a new interagency Memorandum of Understanding is in the works to incorporate the remaining 206 laboratories into this database. **Bethany Loftin**, director of the Technology Partnerships Office at the **National Institute of Standards & Technology (NIST)**, confirmed that the final signature for this agreement is anticipated soon.

Michael clarified that while the initial 400 patents will be available for free, future access to the larger database may involve negotiations. He likened the free patents to supermarket samples designed to attract customers. “It’s the freebie … the door-buster … the loss-leader,” he explained, indicating that the goal is to pique interest in the broader patent portfolio.

Leveraging AI for Innovation

The initiative is part of a larger vision to harness technology and streamline processes within the Pentagon. Michael’s team has been employing AI to manage and categorize the vast array of patents, which are currently disorganized across multiple organizations.

**Clara Asmail**, a contractor in Michael’s office, highlighted the challenges of compiling data from various laboratories, noting that manual organization is no longer feasible. “We now finally have nascent AI tools that, if we apply them carefully, we can start that process.”

As the Pentagon moves forward with this initiative, the potential for collaboration with the private sector may lead to significant advancements in military technology. Michael’s optimism about the pilot program suggests a willingness to adapt and evolve the approach based on industry feedback and engagement.

The implementation of these strategies could pave the way for a more innovative defense landscape, leveraging the expertise of private industry to enhance military capabilities.
