New York Courts Challenge New York Post Claims on Judge’s Actions

The New York City court system has publicly criticized claims made by the New York Post regarding a local judge’s handling of a migrant’s court appearance. The article, titled “ICE agents chase down migrant ‘sex predator’ after judge allows him to stroll out of NYC courthouse,” alleges that Judge Sheridan Jack-Browne permitted a violent offender to escape from Immigration and Customs Enforcement (ICE) custody.

The case revolves around Gerardo Miguel Mora, a 45-year-old man deported in 2011 after multiple allegations of sexual assault and strangulation. Mora re-entered the United States illegally and was arrested last month for a minor shoplifting offense. The New York Post contended that Judge Jack-Browne allowed Mora to exit the courtroom freely, resulting in a chase by ICE agents.

According to a spokesperson for the Unified Court System, the Post’s article contains “serious factual errors.” The statement emphasized that Judge Jack-Browne was not presented with any active warrant for Mora’s arrest and acted in accordance with legal protocols during the court proceedings. It noted that Mora appeared at 100 Centre Street for a misdemeanor charge of petit larceny, which, by law, did not permit bail or detention.

The court’s statement detailed that after the prosecution recommended supervised release, and with no objection from the defense, the judge ordered Mora’s release. Notably, it refuted the claim that Mora “fled through a back door,” asserting that he left the courtroom on foot at 12:55 p.m. and remained inside the courthouse until 13:47 p.m.. Security footage confirmed that he exited in handcuffs and was accompanied by federal law enforcement officials.

The spokesperson further stated that the New York Post was alerted to these inaccuracies and had agreed to amend the article. As of October 17, 2023, the publication had not corrected its report and even issued a follow-up opinion piece that reiterated the initial claims.

The Unified Court System expressed frustration over the Post’s failure to adhere to its commitment to rectify the misinformation. The statement concluded by underscoring the importance of accurate reporting in matters of public interest, particularly in sensitive cases involving the legal system and immigration enforcement.
