Judge Orders Trump to Release Control of California National Guard
URGENT UPDATE: In a groundbreaking ruling, U.S. District Judge Charles Breyer has ordered President Donald Trump to “get your damn hands off” the California National Guard, compelling the Trump administration to cease its federal troop deployment in Los Angeles. This decisive ruling, issued on October 25, 2023, marks a significant victory for state sovereignty over federal intervention amid ongoing tensions regarding immigration enforcement.
The judge’s order ends a months-long standoff between the Trump administration and the state government, which argued that the federalization of the National Guard was unjustified. Breyer found the administration’s claims—that federal troops were necessary to protect immigration agents from protests—unconvincing.
Former federal prosecutor Glenn Kirschner, who discussed the ruling in a recently released video on his Substack, expressed his astonishment, stating, “I’m paraphrasing the actual ruling by Judge Breyer, but that’s kinda what he said, ‘Get your hands off of the National Guard and return control to Governor Gavin Newsom‘.” Kirschner’s passionate response highlights the emotional weight of the ruling, as he remarked, “I love it when they talk like that. Gives me the justice goosebumps.”
The implications of this ruling are profound. President Trump has repeatedly attempted to deploy the National Guard in various states to provide security for immigration enforcement, but judges across the country have largely dismissed these justifications. In a related case, a federal judge in Oregon previously asserted that the Trump administration was fabricating conditions to support its deployment strategies.
This latest decision not only empowers Governor Newsom but also sets a critical precedent regarding the limits of federal authority in state matters. As tensions over immigration policy continue to escalate, the ruling serves as a reminder of the judiciary’s role in balancing federal and state powers.
As this story develops, it will be crucial to monitor the administration’s response and any subsequent legal challenges. Stay tuned for more updates as the situation unfolds.
This ruling has ignited discussions on social media, with users rallying around state authority and the judicial system’s checks on executive power. Share your thoughts on this landmark decision!
